Terms of Service

NicheSpotted is a SaaS product operated by Salvatore Castellitti, an individual based in Italy. The service provides App Store intelligence, keyword research, and niche analysis tools for developers and entrepreneurs.

You must be at least 13 years old to use NicheSpotted. By creating an account, you confirm you meet this requirement. If you are under 18, you represent that you have your parent or legal guardian's permission to use the service.

NicheSpotted is intended for professional and commercial research purposes. You agree not to use the service for any unlawful purpose.

You must provide a valid email address to register. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

You agree to notify us immediately at s.castellitti.dev@gmail.com if you suspect any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.

NicheSpotted offers paid plans billed on a monthly basis. Payments are processed by Polar (polar.sh), our third-party payment provider. By subscribing, you authorize Polar to charge your payment method on a recurring monthly basis.

Prices are displayed in USD and are subject to change. We will notify you at least 14 days before any price change takes effect on your subscription.

Your subscription renews automatically unless cancelled before the renewal date. You can cancel at any time from your account settings.

All payments are final and non-refundable. We do not offer refunds, credits, or prorations for any subscription fees, including but not limited to:

• Partial months of service
• Downgrading or cancelling your plan
• Unused features or access periods
• Accidental or duplicate purchases

By subscribing, you acknowledge and agree to this no-refund policy. If you believe there has been a billing error, contact us at s.castellitti.dev@gmail.com within 30 days of the charge and we will investigate.

You agree not to:

• Scrape, copy, or redistribute data from NicheSpotted without written permission
• Use the service to build a competing product
• Circumvent any rate limits, access controls, or security measures
• Share your account credentials with others
• Use automated tools (bots, scripts) to access the service beyond normal use
• Attempt to reverse-engineer or decompile the platform

All content, trademarks, and technology on NicheSpotted are owned by Salvatore Castellittior licensed to us. You may not reproduce, distribute, or create derivative works without our prior written consent.

Data retrieved from the Apple App Store through our platform remains subject to Apple's terms. We do not claim ownership of third-party data.

NicheSpottedis provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that data will be accurate or complete.

App Store data sourced from Apple's public APIs may be incomplete, delayed, or inaccurate. You use this information for research purposes at your own risk.

To the maximum extent permitted by Italian law, Salvatore Castellitti shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of NicheSpotted, including loss of profits, data, or business opportunities.

Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 3 months preceding the claim.

You may delete your account at any time from your account settings or by emailing s.castellitti.dev@gmail.com. Upon deletion request, your personal data will be permanently deleted within 7 weeks.

We may retain anonymized, aggregated data that cannot identify you, and records required by law (e.g., billing records) for the legally required retention period under Italian and EU law.

We reserve the right to suspend or terminate your account at any time, without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to access the service ceases immediately.

You may terminate your account at any time by cancelling your subscription and deleting your account.

These Terms are governed by the laws of Italy. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Italy, except where mandatory consumer protection laws of your country provide otherwise.

EU residents have the right to use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
